To be in a regular situation in Spanish territory, you must have your tax identification number in order to comply with your tax obligations. On the other hand, if you are a non-EU national, you must have a visa that allows you to reside in Spain for more than 90 days on a regular basis.

As mentioned above, in order to be able to stay regularly in the State, the non-resident foreigner must have a tax identification number or also called NIE (NUMBER OF FOREIGNER IDENTIFICATION NUMBER). This identification number is essential to be able to invest in the country. Differences between TIE and NIE. wait…. Aren’t they the same thing?

TIE
The TIE is an identification document issued in Spain for non-EU and EU citizens who reside in the country for a period of time longer than 180 days. This card is required for foreigners who wish to live, work or study in Spain. The TIE contains the holder’s personal information, such as name, photograph, identification number, fingerprint and expiry date.
NIE
The NIE is a unique identification number assigned to foreigners who have economic, legal or social interests in Spain, but are not resident in the country. The NIE is necessary to carry out various legal transactions, such as buying property, opening a bank account, working as a freelancer, among others. The NIE is not a physical card, but an identification number that is used in different legal procedures.
What about non-EU foreigners?
Los extranjeros no comunitarios no disfrutan la opción de poder residir en España con total libertad ya que no contemplan los beneficios de la ESPACIO SCHEGEN. Ellos, a efectos legales, únicamente pueden disfrutar de una instancia no superior a 90 días por año. Para poder residir de una manera regular y poder entrar al país con total seguridad durante más de 3 meses, deberán tramitar un VISADO que les permita residir durante el tiempo que indique, según el VISADO, en el país de manera controlada.
I want to live in Spain but pay my taxes in my country, can I get any tax benefits?
As a general rule, foreigners who reside in the country for more than 180 days are obliged to submit all their personal income for personal tax purposes, even if they have a visa which only authorises them to reside in the country for one year. However, with the rise of the popularly called GOLDEN VISA, it is possible to stay more than 180 days in the country, choosing where to tax your personal income.
